to add rule 33 regarding the hybrid meeting and technological

Sit I should read city clerk Senate bill seven oh seven effective January one twenty twenty six
substantially amended the California brown act these amendments include a requirement that the city council adopts a policy regarding disruption for internet service occurring during hybrid media

occurring during hybrid meetings. The proposed resolution restates the
council's existing rules of procedure so not changing anything in their entirety
while also adding rule 33 to comply with obligations of Senate bill 707. The rule
includes three provisions section a requires that all meetings of the city
We're already doing section B describes the procedures that will be followed if the internet service enabling hybrid meetings is disrupted
Section C provides limited circumstance where the City Council may hold a meeting without providing a hybrid option
To come to a compliance with Senate bill 707 this proposal rule 33 should be adopted prior to July 1

require two way public participation, not just observation.
I wanna flag that this is not how all city bodies
are currently operating.
The police commission is currently limiting zoom
to observation only and directing the public
to submit written e-commence instead.
But written comments are not the same
as real time public participation
and that approach does not align with state law
or what this rule requires.
There's no exception in SB 707 or rule 33
for staffing or implementation constraints.
So as council adopts this,
I ask that you also ensure consistent implementation
across all boards and commissions
so the public has the same access everywhere.

for issuing a clear public legal opinion
on the police commission vacancy process.
That guidance matters.
The opinion makes three important points.
First, selecting an alternate is not automatic.
It requires formal commission action.
Second, that action must be appropriately noticed.
And third, even after selection, the role is temporary
and still subject to full selection panel
and council confirmation process.
That clarity is important because it defines
when a decision actually happens
and how the commission's role fits with council authority.
I also wanna note a broader pattern.
Since 2020, about one in four public legal opinions
from the city attorney have involved the police commission.
That's not a small government number.
It suggests ongoing questions about structure,
process and governance.
And as the auditor has said, it's not just about staffing,
it's about making sure the system is clear,
consistent and accountable.
