Consideration of a resolution approving a conditional use permit, CUP, to establish
an outdoor vehicle storage yard associated with a towing company located at 476 Whitney
Street, APN 778-743-23, Zoning District IG. May we please have the staff report.
Good evening, Chair and Commissioners. My name is Felipe Morphine-Martinez. I am the
project planner of the item before you, project number PLN 250031. This
is a request for a conditional use permit to establish an outdoor vehicle
storage yard associated with a towing company at 476 Whitney Street. Tonight I
will be providing an overview of the proposal, staff analysis, and
recommendation. The applicant and owner Parvenice Chond, present here today, is
requesting a conditional use permit to establish an outdoor vehicle storage
yard at 476 Whitney Street within the 22,500 square foot lock. The applicant
proposes to use the existing gated area at the rear of the property for outdoor
vehicle storage use. The site is located on the west side of Whitney Street
between Adam Avenue and Edison Avenue within the industrial general zoning
district and is not adjacent to any residential zones or use. Adjacent uses
include warehouse, light manufacturing, as well as professional offices. The broader
area contains a variety of industrial uses including warehouses, contractor
yards, manufacturing facilities, and professional business offices. The
proposed use fits within the context of the surrounding area and is not expected to impact
adjacent uses. The 22,500 square foot lot contains an existing four unit commercial
building of approximately 9,800 square feet. Of those four units, one is used as a storage
unit and the rest are vacant but were previously occupied as office spaces. The site currently
contains 17 parking spaces and a gated area towards the rear of the lot. The applicant
proposes to use the fenced-off area highlighted here in blue on the site
plan for the vehicle storage use. This space is approximately 5,400 square feet.
The connected unit highlighted in purple 476 Whitney Street would be used as the
administrative office for the towing company. Sign improvements include
re-striping of the parking lot without reducing existing parking count. Upgrading
existing fencing and security gates and installing approximately 72 square feet
of new landscaping within planter boxes.
Moving on to operations vehicle deliveries may occur
at any time 24 hours a day seven days a week
with an anticipated two tow truck trips per day.
All vehicle deliveries will be conducted within the gated area.
The secure outdoor storage area would accommodate up to 20 vehicles on a
rotating basis. As seen in the image vehicles would be
stored in a tandem when the vehicle yard is at capacity. The storage and
retrieval within this gated yard would be limited to train staff and not
accessible to the general public. The local towing service would operate with
two employees during regular business hours 8 a.m. to 5 p.m. Monday through
Friday. Vehicle retrievals will only occur during these standard hours. The
project complies with industrial general zones and meets all parking requirements.
It is compatible with its surroundings and it is consistent with the general plan by supporting an industrial land use and transportation related services the project
Which the project with its limited operations does not anticipate to cause significant traffic or public service impacts
To ensure the project maintains compatibility staff has recommended a number of conditions of approval
Some of which include use limitations to towing operations only with car rituals during standard business hours
maintenance of the site keeping the site in orderly fashion upkeeping landscaping ensuring noise is minimized
environmental compliance for vehicle fluids hazardous materials
Ensuring proper assessment containment and disposal of hazardous materials
Staff has amended condition of approval number 24 to include language regarding stormwater management and ensuring compliance with alameda County wide clean water programs
Best management practice for towing and auto storage. This amendment has been provided to you all tonight
And I would also like to highlight a condition to install one bicycle space one bicycle space on site
Given the proposed project complies with all applicable code
It will not impact any residential use and adheres to the general plans desire to maintain and protect
industrial uses within an industrial zone
Staff recommends the Planning Commission approve conditional use permit PLN 25-0031
Based on the findings of fact to establish an outdoor vehicle storage yard at 476 Whitney Street

I think that's really important.
And I'm also excited about the bicycle spot.
I do have a question, and it may be for the applicant,
regarding after hours drop off.
I understand that the facility is open 24 hours a day,
seven days a week for drop off, and that there's
approximately 40 hours a week when it's available
for customers to come in and pick up their car.
The condition 24 provides objective criteria
for stormwater pollution prevention.
Once a vehicle is inside the 20 spot area.
I'm interested in what the procedure is
when someone drops off after hours.
So for example, if it was open now
and the car was dropped off tomorrow, Friday at midnight,
does that vehicle go inside those 20 spots
or does it sit outside that fence?
And if it sits outside the fence,
is there any protocol procedures planned
for containment of potentially hazardous fluids
from vehicles, specifically a vehicle
that has been in an accident and then got to that?
Okay, so it's kind of a two-part question.
Yeah.
Yes, so the vehicle storage area
is within the fenced-off area,
so any drop-off of any vehicle within any timeframe
would have to go within the gated impound area.
So regardless if it's two in the morning,
it would be within that gated area.
And actually per the code, the parking requirements,
the two available parking spaces outside of that.
So you can see here, 11 and 12,
they're associated with 476.
Those are for pickup purposes.
