DISCLOSURE OF EX-PARTE COMMUNICATIONS This portion of the meeting is reserved for Design Review Commissioners to disclose any communications, including site visits, they have had on current agenda items, or any conflict of interest regarding current agenda items.
Description: The applicant requests Design Review Commission (DRC) input on the architectural design, site planning, tree removals, and landscape design for a proposed three-story Residential Care Facility for the Elderly (RCFE) on a 3.10-acre parcel at 1350 Montego Way. The project includes 100 residential care units (consisting of 70 assisted living units and 30 memory care units). The memory care component would operate on the ground floor as a secured, self-contained area for residents requiring specialized supervision and support. The project would be restricted to residents 55 years of age or older and would operate as a state-licensed RCFE providing 24-hour resident support. No medical care is proposed on site. The project building contains common areas and amenities, including dining and activity areas, a media room, a music area, and a library. The site changes include a central outdoor courtyard with seating and BBQ areas, tree removals, and new landscaping. Other site improvements include trash enclosure, striped parking, and a porte cochere. The applicant requests consideration of the project under the California Density Bonus Law (Government Code § 65915 et seq.), including waivers from applicable development standards. However, no additional residential units (density) are proposed through the density bonus request. The DRC will not take formal action on the project at this meeting. The Commission’s comments will be advisory and will be forwarded to the Planning Commission for consideration as part of its future review and action on the project. The project includes common areas and amenities, including dining and activity areas, a theater, indoor pool and spa, and two outdoor courtyards, tree removal and new landscaping. Appeal Rights: As provided in Part IV, Article 5 of the Walnut Creek Zoning Ordinance, any interested party may appeal a decision of the Design Review Commission within ten (10) calendar days after the mailing of the decision by filing a written appeal and the applicable appeal fee(s) with the City Clerk’s Office (if such date falls on a weekend or City holiday, then the deadline shall be extended until the next regular business day). Such written appeal shall specify the name of the person making the appeal, identify the decision being appealed, and state the reason(s) for the appeal. Such appeal must be received by the City Clerk’s Office no later than the close of business on the last day of the appeal period. If you wish to receive mailing of the Design Review Commission’s decision, you must file a written request of such notification with the City Clerk’s Office or the Planning Division in advance of the Design Review Commission hearing. If you challenge any of the matters listed under ’Public Hearings’ in court, you may be limited to raising only those issues you or someone else raised at the listed public hearing, or in written correspondence delivered to the City of Walnut Creek at, or prior to, the public hearing. ***OPTIONS FOR PARTICIPATING IN THE COMMISSION MEETING*** TO WATCH OR LISTEN ONLY:

The written comment cut-off time for this meeting is 4:00 p.m. given the 6:00 p.m. start time. • Written Comments received within two (2) hours of the scheduled start time of the Commission meeting and during the Commission meeting will be provided to the Commission the day following the Commission meeting.
