6.A Approval of Meeting Minutes - April 14, 2023 Contracts, Operations, Maintenance, and Safety Committee It is recommended that the Committee approve the Minutes of the April 14, 2023 Contracts, Operations, Maintenance, and Safety Committee. 6.B Contract No. MS318-23 - Railroad Flagging, Training, Inspection & Right of Entry Agreement Services - Recommendation to Award - RailPros Field Services, Inc. (RailPros) The Authority needs to continue to provide Railroad Flagging, Training, Inspections and Right of Entry Agreement Services on an on-call basis to projects within and adjacent to the railroad right of way. It is recommended that the Committee recommend the Board authorize the Chief Executive Officer to award Contract No. MS318-23, Railroad Flagging, Training, Inspection & Right of Entry Agreement Services to RailPros and approve a not-to-exceed contract funding authorization amount of $41,000,000 ($24,600,000 for the base and $8,200,000 for each of the two option years) for the term of the contract. The term of the contract shall be a three-year base term with two one-year options that may be exercised at the sole discretion of the Chief Executive Officer. Work under this contract will be authorized through the Work Order process on an as needed basis. The award is subject to resolution of any timely filed protest. The amounts for which contract authority is requested are included in the Adopted Operation Budget for FY2023-24 ($60,000), previously Adopted Capital Budgets and Third-Party Recollectable agreements. A summary of forecasted on-call work is included in Attachment A. Funding for subsequent years will be requested through the annual budget. There is no financial commitment with respect to subsequent years and work will be authorized only if funding is available. 6.C Quarterly Report of Contracts Awarded and Third-Party Agreements Executed Under the Chief Executive Officer's Authority The Board of Directors approved the Authority's revised Procurement and Contracting Policies (Revised Policies) on November 8, 2019. Section 3 of the Revised Policies requires the Chief Executive Officer (CEO) to provide a Contracts, Operations, Maintenance, and Safety May 12, 2023 Committee Meeting 3 quarterly report to the Board with a list of contracts awarded above $250,000 and under the CEO's contract award authority of $500,000. On July 26, 2019, the Board authorized the CEO to execute Third-Party Agreements (TPAs) with other public agencies up to $500,000, and to provide a quarterly report to the Board with a list of applicable executed TPAs between $250,000 and $500,000. This report meets these Board requirements for the third quarter of FY 2023, which covers January 1, 2023, through March 31, 2023. Receive and file. 6.D System Safety and Compliance - CY23 Quarterly Update Staff is providing a quarterly update on the Authority's safety and compliance status and activities, including strike data, reportable injuries, rule violations, compliance audits, regulatory inspections, and public outreach. So in the event of a fire alarm activation, we are going to all collectively go down and
stage in Pat's Forest Plaza and until we get the all clear from Metro to come back in the
building.
In the event of an earthquake, we're going to shelter in place, get on our desk, large
object in those folks calling a remote request to do the same in the event of a
first aid situation I'm going to ask Jerry to contact 911 provide first aid
if needed and the event of an active attacker we always use the saying run

Good morning chair and members of the committee. I'm Tammy Phillips, contract and compliance
administrator, and I am presenting item 6B for flagging, training, inspection, and right
of entry agreement services. Next slide, please. The authority manages and oversees critical
rehabilitation and third-party recollectable projects that are on or near the right of
which requires flagging, inspection, and safety training
to ensure all safety measures are met.

Contract MS 318-23 is based on a competitive procurement
and will replace the expiring contracts
as well as add right of entry permitting services.

On January 12th, 2023, the authority issued a request
for proposals for flagging training, inspection,
and right of entry agreement services.
36 firms downloaded the solicitation,
and the authority received two proposals
from the incumbent contractors,
Jacob Management, excuse me,
Jacob's project management and RealPro's field services.
Proposals were evaluated with RealPro's ranking the highest.

The next one is a receiving file also,
so 6D system safety and compliance.
Good morning again committee members,
it's my pleasure to present the quarterly report
for system safety and compliance.
Okay so at the end of Q1, including March 31st,
good news report, we have a decrease
in crimes report on our system by 27%
and we also have had a reduction as compared
to last year of incidents affecting our system
by 14%. This really represents a good partnership that we have, not only in reporting, but with
our sheriffs also in doing outreach. We implemented a lot of measures last year when we saw last
year in 2022, a dramatic increase in trespasser events and crime on the system. So these numbers
not only represent a drop, they also represent a trend downward. Next slide, please. As you
see again 2023 compared to 2022 at the same time period we have not only
reduced the events occurring in our system related to strikes we are
maintaining that trend downwards throughout the system again this is
because the good partnership the outreach all the communication we've had
throughout the system that that's really led to these efforts next slide please
rule violations we are unfortunately maintaining consistent trend with rule
violations, most of them are related to, as you can see, lost lack of attention,
situational awareness, communication breakdowns, and we are working
continuously and I will present some information in the next few slides to
talk to that. Next slide please. FRA reportable injuries, again we are sustaining that
trend in terms of reportable injuries in the workplace. Unfortunately we would
like to see that go down but we are working toward that goal in the next few
In terms of regulatory inspections, we've increased the number of inspections although
we've had more defects, the increased trend in inspections allows us to do more efforts
to catch more things before they become an issue on our system.
So this slide in particular is a proactive measure that we've implemented over the past
year.
We do gather and capture a lot of data and information.
What we are attempting to do is to inform everybody within our organization, our contractors,
what to do with this stuff.
So as we are starting to see trends and looking at being more proactive in terms of where
we're seeing issues before they become problems, we are going to start issuing this report
to, again, internal and external stakeholders to let people not only know where the issues
are but help them understand direction in terms of things that they're going to talk
about with their folks and their contractors to make sure issues are addressed so that
They do not ultimately lead to a defect injury or incident in our system.
In terms of training, we undertook a massive effort last year to increase our training.
We have continued to do that, including training our fellow XLT members, past few months.
And that's represented by the numbers you see here.

I just wanted to share the same sentiments.
It's an easy breakdown and I really like the proactiveness approach and really showing
everybody that there's a full conversation about safety and I know that the biggest headline
is always transients, but this shows that we do so much more as an agency.
It's a great way to communicate with residents and people just showing everything MetroLink
does and I I also want to commend the social media team for doing the I saw
like if you ever see an issue here's here's the sign that you need to look
at and the phone number you need a call and where previously I had no clue about
that sign and I talked to others same thing so it's it's a great way to grow
awareness and so thank you to the safety team and everyone. Thank you for the
feedback. I'm glad to see the reduction in strikes that trend. This is a receive and
7. Chief Executive Officer's Report
file. We're just whizzing right through this. Chief Executive Officer report. Yes, thank you,
Madam Chair. Two items to report. Again, we have good news coming out of San
Clemente. The board will recall a couple weeks ago we had to suspend service once
again through San Clemente right after opening up following the Cypress Shores
repairs a little bit further north of Cypress Shores, just north of St. Clemente Pier.
We had a landslide risk that was on city-owned property, City of St. Clemente-owned property.
As of yesterday, the City of St. Clemente has ordered a contract to regrade the slope
that is at risk of falling onto our tracks.
We're told it should take a couple of weeks for that work to be completed.
We'll be tracking it closely along with the Orange County Transportation Authority who
is actually the owner of the corridor.
We serve as their agent and as the operating railroad, but OCTA is the owner.
So we are working in collaboration between the three entities.
Our contractor, Herzog, will be down on our right-of-way maintaining the tracks, moving
dirt if debris falls during this two-week period. Again, we're hopeful that we will
be able to bring back passenger rail service very closely after that two-week period.
Not just for ourselves at Metrolink, but also for Pacific Surf Liner, the Amtrak trains
that go from Los Angeles to San Diego.
The second item is just, again, a plug for next week. If you're a cyclist, May 15th
through 19th is bike to work week.
And if you're a cyclist and you get on our train,
you ride for free.
So we will be, that is already,
the social media efforts on that have already started.
It'll continue in earnest over the weekend.
So again, two positive stories to share with the committee.

Wasn't paying attention, and I realized, I called Mr., our CEO, and he told me, hey, dummy, it's closed.
You have to go to Montclair to get on the train to get down to San Bernardino.
So I did do that, so thank you, Darren, I appreciate that.
He was a lot nicer than that, so just so everybody knows that.
We had a great time.
This first time I was on the Aeroservice was excellent.
The people that were on the train, they just treated us really respectful.
